Notary News & Notes: July 2007

1 – Last month, we had 2 instances where notaries placed their seal on every single page of the loan package. YIKES!!! Most of you know, this is a huge no-no. Not every signature gets notarized. Your notary seal only goes where there is notarial wording, acknowledgements, jurat’s, etc. Remember, do not stamp every page of a loan package!

2 – We are still fighting the battle with notaries not getting their docs out in a timely manner. Telling us the package was dropped off in a box that already had their daily pick up does not work. Unless it is an evening closing, packages must go out same day. Make sure you know where boxes are in your area with late pick up times. If a faxback is going to mean you can’t get the package out, then don’t do the fax back. We’d rather the package go out. Of course, if it is a non-owner occupied closing, the fax back is a must. More on “non-owners” below.  

3 – If you or the borrower messes up on a document, use the client clean copy instead of sending out a package with multiple cross –outs.  Remember, use the client copy if you have incorrectly signed/notarized a document.

4 - If you use a crimper-type seal, please indicate on faxbacks or darken the copy before sending to us to avoid us having to ask. Crimper seals do not show thru on a fax. It appears on our end as if nothing was stamped. For any of you ordering new seals, stay away from crimpers. Yes, they are pretty…but the seals are not photo-reproducible. They are not the best thing to use in this business. Self-inking and the old fashioned rubber stamps are best.

5. Non-owner occupied properties: There are properties such as vacation homes, rent houses, etc. There is no 3-day rescission on these. They fund as soon as soon as the ink is dry on the documents the borrowers sign. As soon as the signing is done, you must find a fax and fax back the critical funding docs. Lenders cannot wait for you to finish your daily appointments. They want the fax within a very short period of time after signing. If you are unable to commit to doing this fax back, we ask that you decline the assignment.
